Mary K. Stabile-Benson ESQ

Mary K. Stabile-Benson is an associate with the Paris P. Eliades Law Firm, LLC. She brings to the firm over 25 years of experience as an attorney. Over those 25 years, Ms. Benson has successfully handled a wide range of legal issues. As a result, Ms. Benson is a seasoned trial attorney, having tried dozens of cases and handled numerous appeals many resulting in published opinions.

Among her many talents, Ms. Benson has substantial expertise in family law matters. She was an attorney in the public defender’s office for 11 years handling child welfare cases, representing children and parents in matters involving the Division of Child Protection and Permanency (formerly DYFS). She was designated trial counsel for F.M. in the matter of the New Jersey Division of Youth and Family Services vs. F.M., 375 N.J. Super. 235 (App. Div. 2005). In that case, due in large measure to her effective and vigorous advocacy, the Appellate Division reversed the trial court’s termination of parental rights finding that a messy house and rash were insufficient grounds upon which a court could terminate parental rights. As a public defender, Ms. Benson was successful in reuniting numerous parents with their children either before or after trial.

Ms. Benson also has experience representing clients in administrative law matters involving both State and Federal agencies. Among other cases, she challenged the denial of an exemption from the permitting requirements of the Freshwater Wetlands Protection Act by the Department of Environmental Protection and Energy, arguing that a soil removal operation should be exempted from the Freshwater Wetlands Protection Act as a valid, pre-existing, nonconforming use.

In Federal forums, Ms. Benson has contested citations issued by the Occupational Safety and Health Administration for an unsafe workplace resulting in a full trial in Federal District Court, an appeal to the United States District Court of Appeals for the Third Circuit and a Petition for Certiorari to the United States Supreme Court.

Currently pending before the New Jersey Appellate Division is a challenge to NJDEP’s denial of a request to invalidate or waive positive e-coli water test results, despite 6 years of subsequent, negative water test results, following Hurricanes Lee and Irene.

Ms. Benson is also an advocate for gun owners and second amendment rights. She has successfully appealed a Superior Court’s denial of an application for renewal of a New Jersey License to Retail Firearms and continues to advocate for gun owners.

Ms. Benson has represented numerous clients in municipal courts charged with traffic violations, trespassing, no insurance, driving while intoxicated and driving while suspended. She has also handled municipal court appeals. Most notably, in State vs. Serge M. Jolicoeur, Ms. Benson successfully argued that defendants in municipal court were entitled to the services of the public defender and should not be denied the right to legal representation because they were unable to pay the $50.00 application fee.

Beyond these examples, Ms. Benson has drafted wills and estates, handled real estate matters, business formations, expungements and name changes. Further enhancing this broad legal background, Ms. Benson is a compassionate and caring advocate for her clients with a strong work ethic who strives to find innovative solutions for her clients.

Ms. Benson earned her Juris Doctorate from New York Law School in 1990. She is a member of the New Jersey State Bar (1990), United States District Court (1990), the United States Court of Appeals for the Third Circuit (2014) and the Supreme Court of the United States of America (2015).
